Every symbol on a brand mark tells a story. For years, “Digital Validation” carried a ™ next to it — on the book cover, in keynote decks, across every client deliverable. As of this week, it carries something different: an ®.
It’s a small visual change. But it marks a real milestone, and it’s worth explaining why — both for what it means for the framework, and for any executive out there building intellectual property of their own.
The ™ Was Never a Placeholder
A common misconception is that ™ is a “starter symbol” — something you use until you get around to making it official. That’s not quite right. The ™ symbol is a legitimate legal claim. It tells the market: I consider this term mine, and I’m using it in commerce to identify my services. You don’t need anyone’s permission to use it, and it doesn’t expire or become invalid while a registration is pending.
In other words, ™ wasn’t a placeholder for “Digital Validation.” It was the correct, active designation for a mark that was already doing real work — differentiating a specific approach to executive branding and credibility-building from every other framework claiming similar territory.

What ® Actually Means
The ® symbol is reserved exclusively for marks registered with the United States Patent and Trademark Office. You cannot use it — legally — until the USPTO has issued a registration number. It’s not a stylistic upgrade; it’s a federal designation.
Registration does a few concrete things a ™ claim alone cannot:
- It puts the world on notice. Registration is searchable and public, which makes it far harder for a competing consultant, author, or brand to claim ignorance if they adopt a confusingly similar term.
- It creates a formal barrier to entry. Others attempting to register something too close to “Digital Validation” in the same class of services now have to contend with an existing registration.
- It signals maturity. For a framework built around executive credibility, walking the walk — registering the IP behind it — is consistent with the whole premise.
The Fine Print Most People Skip
Not all registrations are created equal, and this is the part worth understanding if you’re pursuing your own mark. The USPTO maintains two registers: Principal and Supplemental.
The Principal Register is the stronger tier — it comes with a legal presumption of ownership and validity, and after five years of continuous use, a mark there can become “incontestable.” The Supplemental Register, where marks with more descriptive language often land initially, still earns you the right to use ®, but without those stronger presumptions.
The path from Supplemental to Principal is well-established: five years of consistent, substantially exclusive use in commerce, then a petition demonstrating the term has acquired “secondary meaning” — that people encountering “Digital Validation” now think of one specific framework, not just the general concept of validating something digitally.
The Practical Upgrade
The switch from ™ to ® won’t happen overnight across every touchpoint — book covers, in particular, update on their own printing cycle rather than getting rushed. But it’s the kind of change worth rolling out deliberately: the next print run of the book, the website, keynote decks, LinkedIn content, anywhere the mark appears as a claimed asset.
Small symbol. Real signal. The framework is no longer just a claim — it’s on the record.
